【禁聞】出問題 都是“臨時工”惹的禍?

【新唐人2011年11月26日訊】中國最神秘的機構是「有關部門」,而中國最神秘的行業則是「臨時工」,他們無所不在卻又不存在。在中國,合法權益不能保障,臨時工成了替罪羊,中共的《勞動法》實施十幾年,單位利用「臨時工」之名,侵犯勞動者權益的問題卻依然存在。

最近,從城管執法打人、江西修水縣女警發飆拿資料砸群眾、殘疾人住房被強拆、“中華脊樑獎”偽造文書,到政府公務人員酒後駕駛等等,每個案件的肇事者幾乎都跟「臨時工」有關。

大隊長吳忠強承認,打人的幾個人確實是特警隊的,但不是民警,咱單位的臨時工,在這臨時工作的。

中共《侵權責任法》第三十四條規定,“用人單位的工作人員因執行工作任務造成他人損害的,由用人單位承擔侵權責任。”

北京市博聖律師事務所律師韓一村:「根據法律規定,有些職責他是不能授予臨時工去執法的,當然有些特定的情況,如果警察聘那些臨時工,那是違法的。」

對此,網絡政論作家杜導斌表示,有些單位為了掩護編製外的臨時工,他們會用各種方法向社會撈錢來開支這些工資,警察聘用臨時工,在中國是非常普遍的現象,也沒看過因此受罰的。

政論作家杜導斌:「他們不是警察,然而又執行警察的權力,這種現像在國內是非常常見的,不僅僅是警察部門、城管部,還有很多部門都存在這種現象。」

網友「劍氣如虹」說,這已經成了一道公式,就是有多少野蠻執法,就有多少「臨時聘用人員」,有多少媒體曝光,就有多少「臨時聘用人員」被處理。

中國「臨時工」蓬勃發展的真相到底是甚麼?有媒體分析,聘用臨時工有四大理由,第一,頂替相關責任,棄車保帥,相關部門處理熱點、焦點事件風險較大,需要「臨時工」衝鋒陷陣。而一旦出現偏差、發生問題,自有「臨時工」頂缸。

第二,有利於編織和結牢關係網,如果對聘用人員稍作了解,就會發現這些人員多與這個部門或關聯部門的頭頭腦腦或實權人物有著千絲萬縷的親朋關係,構築了一道錯綜複雜的關係網。

第三,可保廣開財源,「錢途」亨通,無論是財大氣粗還是經費不足的執法部門,都可以執法為名讓臨時工進行亂收費、亂罰款來充實單位的「小金庫」,然後再供給領導者自由支配。

第四,出事後容易辭退,「臨時工」相比「正式工」更好處理,包括隨時辭退。「正式工」野蠻執法雖然可以處理,但是由於有編製,所以一般情況之下難以辭退。

政論作家杜導斌:「中共本身就是亂套,是不明確的,部門職責劃分就不明確,然後有相當一部分,就業很難,上面把城管、警察機關所謂的編製都給掐死,然後下面呢,需要的時候就請臨時的。」

「臨時工」和神秘的「有關部門」,兩者有異曲同工之妙,當中國社會出現問題需要追究責任時,他們會同時出現扮演「揹黑鍋」的角色。

有網友說,自從央視大樓在正月十五被「臨時工」點了蠟燭以後,「臨時工」這個群體就在中國的「揹黑鍋」事業中一片欣欣向榮,只要「有關部門」出了甚麼醜聞,一定都是「臨時工」幹的!

CCP』s "Tort Liability Act," Article 34 provides that

"When the employee causes damage to others in the carrying out of work tasks,

the employer bears the tort liability."

"According to the law, temporary workers are not allowed to carry out some law enforcement tasks

In this regard, Du Daobin (network publicist writer) said

some institutions use a variety of ways to make money from

society to pay wages of the temporary workers in order to

cover them.

how many "temporary hire personnel" are dismissed.

What is the truth behind the flourishing of China's

"temporary workers”?

Some media have found that there are four reasons for hiring

temporary workers.

Firstly, to replace responsibility, they need

“temporary workers” to take risks because the relevant

departments face a burden of bigger risk in

handling “ hot “ events.

Once there is a problem, the “temporary workers”

can be used to carry any blame involved.

Secondly, temporary labor helps build and solidify the network.

After a further investigation of employed staff,

it will be found that many employees are friends and relatives of the head

of department which helps build a complex network.

Thirdly, it helps widen the source of income.

Both rich and poor law enforcement agencies can ask for

arbitrary charges and fines in the name of temporary workers

to enrich their "small treasuries", and then supply the

money to the department leader for free use.

Fourthly, it is easy to dismiss temporary workers.

It is easier to fire "temporary workers" than "official workers"

and “ temporary workers “ can be dismissed at any time.

It is hard to dismiss "official workers" under normal

circumstances because of the system.

Du Daobin: "CCP itself is loosely organized and not clear.

Each department's division of responsibilities is not clear.

Each department faces considerable difficulties

"scapegoats" .

Whenever the "relevant department" had a scandal,
